 The First Amendment: Sports Logos and Mascots 


In our class, we have been discussing the Six Freedoms of the First Amendment. We have also been talking about the Eight Values of Free Expression. The Free Speech Center at Middle Tennesee Univiverity says The First Amendment protects speech, religion, press, assembly, and the right to petition the government. These freedoms are made to make the people of America the "freest" in the world. The First Amendment is made for everyone. 

One story that I found relating to The First Amendment about sports, was the issue of sports logos and mascots using images or terms that may be offensive to African Americans, Native Americans, or other ethnic groups. This is typically protected by The First Amendment. 
Many sports teams have used Native American terms for their team names and mascots. As years have progressed, Native Americans have begun to view the use of these terms as disparaging, demanding that the use of these terms be abolished.  

Sports mascots that are usually deemed disrespectful to Native Americans are normally protected by The First Amendment, but the NFL and other leagues have been ridiculed because of the use of these mascots. The NFL's Washington Football Team previously named the Washington Redskins. The team dropped the term "Redskin" from its name in 2020. The team will now go by just Washington until they can find another name. 

In 1992, a member of the Cheyenne tribe, Susan Harjo, filed a complaint with the federal Trademark Trial and Appeal Board seeking to withdraw the Washington Redskins trademark. Harjo considered the trademark as a violation of Section 2(a) of the Lanham Act, the U.S. trademark law. The complaint suggested that the trademark consisted of "scandalous matter" and "disrepute". 

The District of Columbia Circuit Court of Appeals ruled in Pro Football, Inc. v. Harjo, "that lower courts should consider whether Harjo’s initial claim was barred by the equitable doctrine of laches". 

In 2014, the United States Patent and Trademark Office's canceled the Redskins trademark after petitioners showed the trademark was "disparaging" towards Native Americans, which was prohibited by the law. The Free Speech Center

The Supreme Court of The United States 

The Supreme Court of the United States is the most powerful body judicial body on earth. The court is nominated and selected by the Presidental nomination and the senates confirmation role. The confirmation process is a very important part of being appointed. The Supreme Court of the United States has a total of nine justices. 

In 1803, the Marshall Court was faced with the Marbury v. Madison case. The decision that was made in this case was a turning point in history. The supreme court ruled Madison's SCOTUS unconstitutional through checks and balances. When John Marshall was appointed Chief Justice, he changed the court into a powerful establishment. 

According to uscourts.gov, The supreme court holds a very high role because they get to have the final say in situations.  Judicial review plays a huge role in making sure each branch knows its limit when it comes down to power. The Supreme Court protects civil rights and liberties and they cut out any laws that may violate the constitution. 

The Supreme Court has come a long way from then to now. The Supreme court had to build its way up to gain the power that they have today. They had to establish a balance of power within the three branches, and from there, they had to make altercations to continue to make the court powerful and effective.

Speech Theories: Eight Values of Free Expression 

    As an aspiring Sports Reporter, the right to be able to freely express my thoughts is something that I feel is deeply important. "The Market Place of Ideas" and "Individual Self-Fulfillment" value-free grappling and enable individuals to freely express themselves.  MediaLawLit Freedom of expression is a core value to ensure people are able to exchange ideas in a civil manner. Individuals are able to share information and values that are important to them. I personally think this is fundamental in life. 


Since people have the opportunity to speak freely and say what is on their minds, the expression of "Promoting Tolerance" is an important expression in our world today to ensure  Promoting tolerance allows individuals to speak freely and use hate speech, but it also allows society to enact a sense of punishment for hate speech. Tolerance is about accepting those that do not have the same values and beliefs as you.  Tolerance means treating everyone with respect even if their preferences or opinions do not agree with yours. If we want to have a peaceful society, implementing tolerance is key.  Promoting Tolerance

"Individual Self-Fulfillment" aka Self-Actualization, is a theory that free speech may be justified and intertwined with human autonomy and dignity. As human beings, self-actualization allows us to heighten our personal growth and development. The characteristics of self-actualized people are being realistic, problem-centered, being autonomous, possessing acceptance, and having a spontaneous personality. these characteristics are key for free speech and creating one's own identity. Self-actualization is at the top of Maslow's hierarchy of needs, meaning that this is an important aspect of human behavior. 

The Values of Free Expression are implied worldwide with day-to-day activities but as a Sports Media major, I wanted to research how these values are implemented in sports. One big story that focuses on freedom of speech and protection is Colin Kaepernick's kneeling during the National Anthem. This opened doors for freedom of expression for athletes. The American sporting Industry has various rules and policies for their athletes and fans relating to the First Amendment Rights. There is no policy among most major sports leagues that tell players what they can and cannot do during the National Anthem. After the Kapernick scandal came out, the NFL came out with a policy that players and coaches had to stand during the National Anthem. While the NBA and WNBA followed this policy, the MLB and NCAA have no official policies pertaining to this. Most leagues allowed their players to engage in "peaceful protests". One article stated "If the First Amendment primarily protects citizens against any wrongful infringement on their speech/expression by the government, should it also protect professional players that work for nongovernmental sports organizations? The debate will likely continue for many years to come." First Amendment Voice

Another interesting example of the First Amendment being put to use in sports is a term called "fan heckling".  In 2018, New York Giants fans were arrested for "heckling". This led the fans to sue because they claimed their First Amendment rights were being violated because they were getting in trouble for not being able to freely speak. Fan heckling usually results in penalties for the teams that are playing. For example, during the 2018 World Cup, FIFA fined Mexico because Mexico's fans yelled homophobic slurs at team Germany's goalie. The question that arose after matters like this one occurred is should the fans be penalized for poor behavior and conduct, or is this behavior disrespectful enough altogether that should not be protected by the First Amendment rights? 
This takes me back to C. Edwin Bakers's "Individual Self-Fulfillment". The Supreme court stated ‘‘The First Amendment serves not only the needs of the polity but the needs of the human spirit–a spirit that demands self-expression.’’ The self-fulfillment rationale justifies the protection of freedom of speech for reasons that are not connected directly to the collective search for truth or the processes of self-government, or for any other conceptualization of the common good." Take the time out to consider what it would be like without freedom. Freedom to say what is on our minds is often overlooked in the United States. This is an incredibly important right that helps us in a variety of situations. Most countries are not able to speak their minds in the way we are. We should deeply appreciate freedom of speech and not be hateful or violent to express our point of view.

My Top Five Sources of News and Information

Top 5 News Sources 

The news is an important source within society to inform the public about events around them and how they may affect them. News sources can also be used for entertainment purposes, and for a social gathering space too. In this post, I am going to be sharing my Top 5 news sources and why.


1. WGHP Fox 8 
Fox has always been the news channel that I grew up watching with my family. Here in the Piedmont Triad "Fox 8" is the channel that we recieve. I don't typically watch a lot of news, but when I want information about what is going on around me, this is what I usually watch.  https://myfox8.com/

2. ESPN 

Being a Sports Media major and a sports fanatic, ESPN is my go-to source of news for sports. I am pretty sure I keep my TV on ESPN just about all day. ESPN covers NFL, MLB, NBA, College Football, NCAA sports, and more. ESPN provides "up-to-the-minute" sports news coverage, statistics, scores, highlights, and commentary. They have very interesting segments and shows that are hosted and anchored by some of my favorite broadcasters and reporters. ESPN

3. Instagram 

Instagram is my favorite social media site and the one I use the most. Instagram is a fun way to capture and share images and videos with friends and family. Instagram is also a quick way to find out information. Many news, sports, and entertainment sources have Instagram pages where they post the latest news and information. Instagram

4. Apple News 

Apple News is a mobile app that was developed by Apple, Inc., for Apple products. It is an easy way to stay up to date with news and information since it is right there on my phone. Apple News usually sends out notifications, and if I am interested in the topic, I can click on the link and it will take me directly to the article.  Apple News

5. YouTube 
I watch YouTube all the time and I noticed that they have a news category, and sometimes they have ads with the latest news. I like how these sources of news are in video form because I am a visual learner, so I like to see pictures and videos to learn new things. Having the option to watch a video gives me a better understanding and it helps me pay attention better.
